Agreement and App Store terms
These terms are an agreement between you and Fig Tree Labs LLC for using Mindtote. By downloading, subscribing to, or using Mindtote, you agree to them. Your use of the iOS app is also subject to the Apple Media Services terms and Apple’s Standard Licensed Application End User License Agreement. If these terms conflict with rights that cannot lawfully be limited where you live, those mandatory rights control.
Who may use Mindtote
Mindtote is not directed to children under 13. You must be at least 13 and legally able to agree to these terms. If you are not old enough to enter a binding agreement where you live, a parent or legal guardian must review and agree to these terms for you. Do not use Mindtote if applicable law prohibits you from doing so.
The service and your account
Mindtote is a personal to-do app that shows your tasks alongside calendars available on your device. You are responsible for activity under your account and for keeping your device and sign-in credentials secure. Tell support@mindtote.app promptly if you believe your account has been used without permission. You can delete your account from Settings.
Subscriptions, renewals and cancellation
Mindtote is offered as a yearly auto-renewing subscription billed through your Apple account. The App Store purchase sheet shows the price, billing period, and any introductory offer you are eligible for before you confirm. The subscription renews unless you cancel at least 24 hours before the current period ends. Manage or cancel it in your Apple subscription settings; deleting Mindtote or your Mindtote account does not cancel it. Apple processes payment and refunds and applies storefront-specific billing terms. We will provide any notice or consent required for a price change. Restore Purchases can restore eligible access.
Your content and privacy
You keep ownership of the tasks and other content you create. You give us only the limited permission needed to process content you deliberately send to provide the feature you requested, such as optional AI processing. How data is handled, which information stays on your device, and how to make a privacy request are explained in the Privacy Policy.
License and ownership
Subject to these terms and your App Store rights, Fig Tree Labs LLC gives you a limited, personal, non-exclusive, non-transferable, revocable license to use Mindtote for your own lawful purposes. Mindtote, its design, software, branding, and other company materials remain owned by Fig Tree Labs LLC or its licensors. No rights are granted except those stated here or required by law.
Acceptable use
Do not misuse Mindtote or help anyone else do so. That includes breaking the law; infringing another person’s rights; uploading content you have no right to use; probing, disrupting, overloading, reverse engineering, or bypassing security or usage limits except where law expressly permits it; introducing malware; scraping or reselling the service; or using another person’s information without appropriate authority or notice. We may investigate abuse and limit or suspend access when reasonably necessary to protect people, the service, or our legal obligations.
AI and calendar results
Mindtote uses automated systems to interpret ordinary language and identify potentially actionable calendar entries. Results can be incomplete, delayed, or wrong. Review dates, times, places, and tasks before relying on them. Mindtote is a productivity tool, not medical, legal, financial, emergency, or other professional advice, and it must not be your only reminder or record for something safety-critical or time-critical.
Third-party services
Mindtote depends on services provided by Apple and other providers, including sign-in, calendars, maps, payments, hosting, analytics, and optional AI processing. Their own terms and privacy policies may apply to their services. We do not control those services and are not responsible for outages or changes outside our reasonable control, but this does not limit any responsibility that law does not allow us to exclude.
Changes and availability
We may improve, change, suspend, or discontinue features, and we may update these terms when the service or law changes. If a change materially reduces your rights or materially changes how the paid service works, we will provide notice as required by law. Continuing to use Mindtote after updated terms take effect means you accept them, except where the law requires a different form of consent.
Ending access
You may stop using Mindtote at any time. We may suspend or end access if you materially breach these terms, create risk or harm, or if we must do so for legal or security reasons. Where practical, we will give notice and a chance to fix the issue. Sections that by their nature should survive—such as ownership, disclaimers, liability limits, and accrued payment obligations—continue after termination.
Disclaimers
To the fullest extent permitted by law, Mindtote is provided “as is” and “as available.” We do not promise that it will always be uninterrupted, error-free, secure, or suitable for every purpose, or that automated results will be accurate. We do not exclude warranties or consumer protections that cannot legally be excluded.
Limits on liability
To the fullest extent permitted by law, Fig Tree Labs LLC and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or opportunities arising from Mindtote. Nothing in these terms limits liability that cannot legally be limited, including liability for fraud, willful misconduct, or personal injury where applicable law says it cannot be limited.
Contact and complete agreement
Email support@mindtote.app with questions about Mindtote or these terms. These terms, the Privacy Policy, the applicable App Store terms, and any purchase terms shown before you subscribe form the agreement for the service. If one provision is unenforceable, the rest remain in effect. A failure to enforce a provision is not a waiver of it.
